Narrative from GSP 667 Trooper Elsberry of Dalton Post 5: On Thursday September 22, 2022 at approximately 2308 hours, myself and MCCD Officer Sturdivan were on a single vehicle crash on 1-75 South around mile marker 328. At approximately 2242 we were advised of a white Mini Cooper with a red stripe and a Tennessee license plate of BJV4722 that had fled a traffic stop from a Ringgold PD officer. The vehicle fled on 1-75 South around mile marker 345 and a BOLO was activated. At approximately 2308 the BOLO vehicle passed our location. I pu behind the BOLO vehicle and confirmed it was the correct vehicle. At the time MCCD Officer Sturdivan had pulled out behind me in case the vehicle initiated a pursuit. I activated my emergency equipment and attempted to perform a traffic stop on this vehicle. The vehicle initiated a pursuit and began driving extremely reckless and almost causing multiple car crashes. The vehicle was traveling at an extremely high rate of speed and weaving across all lanes of the interstate. This vehicle was passing on the right shoulder and splitting in between tractor trailers. The reckless nature of the driver and interstate traffic ruled out the use of stop sticks and the box in technique to end the pursuit. The vehicle and I finally came to a stretch of roadway that had no traffic. I setup on the vehicle's rear passenger side quarter panel for a P.I.T. (Precision Immobilization Technique) maneuver. I knew that we were traveling at an extremely high rate of speed (Approximately 120 MPH), and this would be very dangerous. I considered the lives that were previously put at risk and could see that we were approaching more traffic rapidly. I noticed that there was a clear area off the right side of the roadway and planned to make the offenders vehicle go into that clearing. I performed a successful P.I.T. maneuver on this vehicle but lost control of my patrol vehicle. The offender's vehicle and my patrol vehicle crashed off the right side of the roadway. When my patrol vehicle came to a final rest, I cut my seat belt off using my pocketknife and cut away the driver's side window airbag. I saw the offender running into the wood line and exited my patrol vehicle through the driver side window. I drew my service weapon and began giving the offender loud verbal commands to show me his hands and come out from the woods. MCCD Officer Sturdivan then approached from the roadway where he had pulled over after seeing where the crash had happened. A Gordon County Officer had arrived on scene and was covering the tree line while myself and Officer Sturdivan checked the vehicle for other occupants. After clearing the vehicle there was multiple officers on scene and had located the offender in the woods directly across from where I had seen him go in. The suspect was put under arrest and held until medical attention arrived. During a vehicle inventory, Corporal Flowers #621 located a camouflage backpack with approximately 2 pounds of a green leafy substance in 2 clear plastic bags. MCCD Office Sturdivan transported the offender, now identified by his Tennessee I.D. as a Mr. Michael Benning with date of birth
1998 to Hamilton Medical Center where he received further treatment for a broken wrist. After being released, Trooper Story #565 transported Mr. Benning to Whitfield County Jail.
